Terms & Conditions

Effective date: September 22, 2026

Welcome to Tom McClure Coaching. These Terms & Conditions govern your use of www.tom-mcclurecoaching.com (the “Site”) and any coaching, programming, consultations, digital materials, or other services purchased through or arranged through the Site (collectively, the “Services”). “Tom McClure Coaching,” “we,” and “us” refer to Tom McClure Coaching, operated by Tom McClure.

By using the Site, submitting an inquiry, booking a service, or purchasing a product or Service, you agree to these Terms. Additional terms disclosed for a particular purchase or agreed to in a separate coaching agreement also apply. If there is a conflict concerning a purchased Service, the specific terms presented for that purchase control.

1. Coaching Services

Services may include personalized exercise programming, strength coaching, technique instruction, general nutrition and lifestyle coaching, progress review, and related educational materials. The precise deliverables, duration, communication method, and price for a Service are those stated on its purchase page or in a written proposal accepted by you.

Unless expressly stated in writing, purchasing a program does not include unlimited access to Tom McClure, live supervision of workouts, in-person training, emergency assistance, or a guarantee of a specific number of calls or revisions. A request submitted through the contact form is an inquiry; it does not reserve a coaching place or create a coaching relationship.

We may decline or discontinue a prospective coaching engagement if we determine that the requested service is outside the scope of our offerings or cannot reasonably be provided.

2. Eligibility and Information You Provide

You must be at least 18 years old to purchase Services unless a separate written arrangement is made with a parent or legal guardian.

You agree to provide accurate information relevant to the design and delivery of your program, including your goals, exercise experience, available equipment, and any limitation or condition you believe affects your ability to participate. You agree to update that information if it changes. You are responsible for selecting weights, equipment, exercises, and training conditions appropriate to your circumstances and for stopping an activity if you experience pain, dizziness, unusual shortness of breath, or another concerning symptom.

Providing information through the Site does not create a real-time monitoring or emergency response service. Do not use the contact form or coaching messages for emergencies.

3. Nature of Fitness and Nutrition Information

Coaching and Site content are provided for fitness education and general wellness purposes. We do not diagnose or treat a disease or injury, prescribe medication, or provide medical nutrition therapy through the Site. A coaching plan may need to be changed or discontinued if the information available to us indicates that the requested work falls outside the scope of the Services.

You remain responsible for deciding whether and how to use the information provided, for exercising within your abilities, and for the conditions in which you train. You must not represent that a program was individually assessed for another person or share your personalized program for someone else to follow.

4. Exercise Risks and Separate Participation Agreement

Physical training, including resistance training and strongman movements, involves risks. These include strains, falls, equipment failure, aggravation of an existing condition, and serious injury. Remote coaching does not allow Tom McClure to inspect your training area, control your equipment, or physically supervise your technique.

Before participating in paid coaching, you may be required to complete an intake form and separately accept a Participation Agreement and Assumption of Risk/Waiver identifying the activities and risks involved. These Terms do not replace that separate agreement. Nothing in these Terms excludes liability that cannot lawfully be excluded.

5. Results and Testimonials

Progress varies with starting condition, consistency, recovery, nutrition, training environment, and other individual factors. We do not guarantee changes in strength, weight, body composition, appearance, competition results, or health.

A testimonial or client example describes that person’s experience. It is not a promise that another client will obtain the same result.

We will not use your name, image, progress photographs, measurements, testimonial, or training video to promote the business without your separate permission.

6. Prices, Payments, and Program Terms

Prices and what is included in a purchase are displayed at checkout or stated in an accepted written proposal. Applicable taxes and any separately identified fees will be disclosed before payment. You authorize the payment method you provide to be charged for purchases you make.

A fixed-duration program runs for the term disclosed when purchased and ends at the conclusion of that term unless the offer expressly states otherwise. Unused access, sessions, or materials do not automatically extend a fixed-duration program. Any installment arrangement for a fixed-duration program will be identified before you purchase; ending participation does not, by itself, cancel amounts you agreed to pay for that program.

We will not change the price or material deliverables of an active purchase without providing notice and obtaining any consent required by law. A later change to the Site’s listed prices does not alter the price already agreed to for an existing purchase.

7. Recurring Subscriptions and Cancellation

A plan identified at checkout as a monthly subscription continues and is charged at the disclosed interval until you cancel. Before you authorize payment, its checkout must display the recurring price, billing frequency, any minimum commitment, and how to cancel. A fixed-duration plan does not renew automatically unless its checkout expressly says that it does and you specifically consent to that arrangement.

You may cancel a recurring subscription through the cancellation control in your site account, if one is provided, or by emailing tmcclure9975@gmail.com with the subject line “Cancel subscription.” Include the email address used for the purchase so we can identify the subscription. You may make a cancellation request online without calling us. We will confirm when recurring billing has been stopped. Cancellation stops future renewals; access already paid for generally continues through the end of the current billing period, subject to the Refund Policy and applicable law.

We will provide any purchase acknowledgment, renewal notice, price-change notice, or cancellation method required by applicable law. If we offer a trial or promotional rate that later changes to a paid or higher rate, the price and timing will be disclosed before you enroll.

8. Scheduling and Missed Appointments

If a purchased Service includes an appointment, its duration and any rescheduling or cancellation deadline will be disclosed when you book. If Tom McClure must cancel an appointment, we will offer a reasonable opportunity to reschedule or an appropriate refund for the undelivered appointment. Rules concerning client cancellations, missed appointments, and refunds are set out in the applicable booking details and our Refund Policy.

9. Refunds

Our separate Refund Policy explains when payments may be refunded and how to request a refund. It forms part of these Terms. Any refund right required by applicable law remains available.

10. Coaching Materials and Site Content

The Site and materials Tom McClure creates for a client, including written programs, videos, graphics, and educational materials, are protected by applicable intellectual property law. After paying for a program, you receive a personal, nonexclusive license to use the materials provided to you for your own training during the access period stated in the offer.

You may not sell, publish, upload, redistribute, or use coaching materials to train others without our prior written permission. You may not copy or reuse Site photographs, branding, or other content except as permitted by law.

11. Accounts and Conduct

If you create a site account, you are responsible for keeping your sign-in information secure and for activity carried out through your account. Notify us promptly if you believe someone else has accessed it.

You agree not to interfere with the Site, submit unlawful or abusive material, impersonate another person, or misuse another client’s private information. We may restrict access for a material violation of these Terms, subject to any rights you have concerning a paid but undelivered Service.

12. Third-Party Services

The Site may use third-party services for hosting, payments, scheduling, video, or communication and may link to other websites. Their own terms and privacy practices may apply. We are responsible for the Services we agree to provide, but cannot control the availability or content of independent third-party websites.

13. Service Interruptions

We may make reasonable changes to delivery methods, technology, or scheduling when needed to provide the Services. If an interruption materially prevents us from delivering a paid Service, we will provide a reasonable alternative, extension, or refund for the undelivered portion, as appropriate.

14. Limits on Liability

To the extent permitted by applicable law, Tom McClure Coaching is not responsible for indirect or consequential losses arising from use of the Site or Services. For claims arising solely from a breach of these Terms or a problem with digital Site functionality, and not involving bodily injury, fraud, intentional misconduct, or another claim that cannot lawfully be limited, our aggregate liability will not exceed the amount you paid us for the Service giving rise to the claim during the preceding 12 months.

Nothing in this section eliminates a right or remedy that applicable law does not allow us to eliminate. Any separate participation waiver applies only according to its own terms and applicable law.

15. Changes to These Terms

We may update these Terms by posting a revised version with a new effective date. A revision applies prospectively. If a change materially affects an active paid Service or recurring subscription, we will provide notice and any choice or cancellation opportunity required by applicable law.

16. Governing Law

These Terms are governed by the laws of Arkansas, United States, except where applicable consumer protection law requires otherwise. Any dispute will be brought in a court that has jurisdiction under applicable law. This section does not remove a consumer’s rights under the law of the place where that consumer resides.

17. Severability and Contact

If a provision of these Terms is held unenforceable, the remaining provisions will continue to apply to the extent possible.
